CODE OF ETHICS FOR EMPLOYEES OF PLEVEN PHILHARMONIC
SECTION I.
GENERAL PROVISIONS
Article 1. (1). This Code establishes the rules of conduct for employees of the Pleven Philharmonic Orchestra and aims to enhance public trust in their professionalism and morality, as well as to raise the prestige of this institution.
(2). The activities of employees are carried out in compliance with a set of norms of behaviour that serve entirely the life and health of the individual and society, in compliance with the principles of humanity, dedication, and a sense of responsibility in the exercise of professions, combined with the principles of legality, loyalty, honesty, impartiality, political neutrality, accountability, and transparency for all employees.
(3). Employees fulfill their official duties in strict compliance with the legislation of the Republic of Bulgaria depending on the functions they perform, propose and make decisions that lead to strengthening trust in the cultural institution – Pleven Philharmonic Orchestra, by carrying out their activities competently, objectively, and in good faith with a desire to continuously improve their work in the interests of citizens.
(4). In fulfilling their official duties, the employee treats everyone with kindness, courtesy, and respect, while respecting the rights and dignity of the individual and does not allow any form of discrimination.
SECTION II.
ETHICAL VALUES
Article 2. In the exercise of their profession, each employee adopts the following values:
2.1. Professional competence and responsibility;
2.2. Honesty, humanity, and mercy;
2.3. Conscientiousness;
2.4. Tactfulness and politeness in relations with society.
2.5. Aversion to self-confidence and boasting;
2.6. Tolerance of religious beliefs, ethnic traditions, political beliefs, and political affiliation of the individual;
2.7. Equal treatment of people with different social, social, and material status.
Article 3. In the exercise of activities related to the administrative services of the staff of the Pleven Philharmonic Orchestra, the following ethical values are applied: legality, timeliness, accuracy, conscientiousness, impartiality, protection of personal data, and personal information about employees that have become known in connection with the performance of their official duties.
SECTION III.
INTERACTION BETWEEN MANAGEMENT,
EMPLOYEES AND CITIZENS
Interaction between the administration and other employees
Article 4. The employee is obliged to protect the personal data and personal information of citizens that has become known to him/her during or in connection with the performance of his/her official duties.
Article 5. The employee carries out administrative services following the law, in a timely, accurate, conscientious, and impartial manner. He/she answers the questions asked, following the functions he/she performs, as necessary, and refers to another employee with the appropriate competence.
Interaction between orchestra musicians
Article 6. Collegiality is a fundamental duty that must be observed.
Article 7. It is prohibited to slander a colleague, gossip about him/her, and spread accusations that are likely to harm him/her in the exercise of his/her profession. Professional and personal disagreements between colleagues cannot be the subject of public debate.
Article 8. It is unworthy to belittle a colleague by assessing and criticizing his/her professional activity or by making demands against his/her personality.
Interaction between employees in the administrative sector
Article 9. In his/her relations with his/her colleagues, the employee shows respect and correctness and does not allow behaviour that undermines the dignity and rights of the individual. The employee respects the opinions of his/her colleagues and respects their right to privacy.
Article 10. When disagreements between colleagues cannot be resolved by themselves, they seek the assistance of their immediate supervisor. When the immediate supervisor cannot resolve the disagreement between his/her subordinate employees, he/she is obliged to inform the Director.
Article 11. By his/her personal behaviour and sense of responsibility, the employee must set an example for other employees, managers, and subordinates.
Interaction between categories of personnel and the public
Article 12. The orchestra musician is an active member of society, contributing to the popularization of cultural life and the spiritual growth of society. Society owes him/her respect, good material security, and protection of his/her dignity. Each employee establishes his/her authority with his/her professionalism, competence, knowledge, skills, and nobility in his/her relationship to society.

Article 13. (1) While performing their official duties:
13.(1).1. The employee is obliged to adhere to the official hierarchy and strictly comply with the orders of the Director and superior authorities.
13.(1).2. The employee may request written confirmation of an oral order if it contains an obvious legal violation.
13.(1).3. The employee should openly and honestly present any issues encountered during work to their supervisor.
(2) Employees of the Pleven Philharmonic may not use their official position or information acquired during the performance of their duties for personal or third-party gain.
(3) Employees of the Pleven Philharmonic may not accept benefits from third parties that could reasonably be perceived as compromising their integrity and fairness in the performance of their duties.
(4) Employees of the Pleven Philharmonic must avoid financial dependence or other entanglements with external individuals or organizations that could influence their official duties.
(5) Employees of the Pleven Philharmonic must oppose corrupt practices and other unlawful acts, promptly informing their immediate supervisor.
(6) Employees of the Pleven Philharmonic should not express personal opinions that could be mistaken for official comments.
(7) Employees of the Pleven Philharmonic may not disclose information obtained during their official duties except in cases explicitly provided by law.
(8) Employees of the Pleven Philharmonic must safeguard the entrusted property and not use it for personal purposes.
(9) The employee is required to promptly inform their immediate supervisor, or if not possible, a higher-ranking official, of any loss or damage to the property, documents, or data of the Pleven Philharmonic administration.
(10) The employee may not remove property and documents of the administration from the premises where they perform their official duties.
(11) The employee may not grant access to the administration’s property and documents to external persons except in cases explicitly provided by law.
SECTION IV.
MAIN RIGHTS AND OBLIGATIONS RELATED TO COMPLIANCE WITH THE PERSONAL DATA PROTECTION ACT WHEN PROCESSING PERSONAL DATA
Article 14. Personal Data
(1). “Personal data” refers to any information relating to an identified or identifiable natural and/or legal person, defined in Article 4, item 1 of Regulation (EU) 2016/679.
(2). Principles of Personal Data Protection:
а) Principle of limited collection – the collection of personal data must be within the necessary limits. Information must be collected lawfully and objectively;
б) Principle of limited use, disclosure, and retention – personal data must not be used for purposes other than those for which it was collected, except with the consent of the individual or as explicitly provided by law. Personal data must be retained only as long as necessary for these purposes;
в) Principle of accuracy – personal data must be accurate, complete, and up-to-date as necessary for the purposes for which it is used;
г) Principle of security and protection – personal data must be protected with security measures appropriate to the sensitivity of the information.
Article 15. (1). Employees of the Pleven Philharmonic are responsible for ensuring regulated access to official premises and safeguarding registers containing personal data.
(2). The responsibility for safeguarding registers with personal data is personal for each official.
Article 16. Employees of the Pleven Philharmonic may not disclose information about personal data acquired during their official duties and must guarantee the confidentiality of personal data in medical documentation.
Article 17. Main Rights and Obligations of Employees of the Pleven Philharmonic concerning Compliance with the Personal Data Protection Act (PDPA) When Processing Personal Data:
(1). To process personal data lawfully and in good faith;
(2). To use personal data to which they have access only for the purposes for which it is processed;
(3). To maintain personal data in a form that allows identification of the relevant individual for no longer than necessary for the purposes for which it is processed;
(4). Not to disclose personal data to which they have access during or in connection with their duties;
(5). To comply with the requirements of the Personal Data Protection Act by keeping confidential the information received in connection with their work, which could harm the reputation and prestige of the Pleven Philharmonic;
(6). To ensure and guarantee regulated access to official premises and protect registers containing personal data;
(7). Not to engage in unauthorized access and transfer of data over the internet or visit unauthorized sites during working hours;
(8). To provide consent for the processing of their personal data, which must be personal and informed;
(9). Individuals whose personal data is processed have the right: to access their personal data, correct errors in their personal data, delete their personal data, and withdraw their personal data.
SECTION V.
PROFESSIONAL CONDUCT
Article 18. (1). Employees of the Pleven Philharmonic shall carry out their duties in the interest of the public. They are required to perform their duties honestly, impartially, and in a manner that instils confidence in the authorities that they can be trusted and relied upon. They must be aware of and adhere to their professional rights and obligations as stipulated by the relevant legal framework.
(2). The employee shall perform their duties honestly and impartially, ensuring that personal political biases do not influence their work. They must respect the official hierarchy and strictly comply with the orders and directives of higher authorities.
SECTION VI.
CONFLICT OF INTEREST
Article 19. An employee shall not participate in the discussion, preparation, decision-making, or execution of a decision when they or associated persons have an interest in the decision, or when they have relationships with interested parties that create reasonable doubts about their impartiality.
Article 20. When assigned a task that could lead to a conflict between their official duties and private interests, the employee must promptly inform their supervisor.
Article 21. An employee shall not use their official position to advance personal or family interests.
SECTION VII.
OTHER PROVISIONS
Article 22. Upon initial appointment, the immediate supervisor is obligated to acquaint the employee with the provisions of this Code.
Article 23. Employees of the Pleven Philharmonic who fail to adhere to the behavioural norms outlined in this Code are subject to accountability under the Labour Code.
Article 24. Upon initial appointment, the immediate supervisor must acquaint the employee with the provisions of this Code within seven days of assuming their duties. Copies of this ethical code are published on the Pleven Philharmonic’s information page at: www.plevenphil.com.
Article 25. For cases not covered by this Code, the provisions of the Law on Financial Management and Control in the Public Sector, the Law on Prevention and Disclosure of Conflicts of Interest, and the Labour Code shall apply.
Article 26. This Ethical Code shall enter into force from the date of its amendment.
Article 27. The Ethical Code was amended and supplemented by Order No. 23 / 01.02.2024 of the Director of the Pleven Philharmonic.
